This article analyzes the relationship between the institutional structure of European social democracy and the development of 20th Century law, based on the critical work of Roberto Mangabeira Unger. The text begins by contextualizing social democracy today. It then goes on to consider how the Brazilian philosopher comprehends the constitution of the �idealist and formalist� law that informs most �progressive� approaches in contemporary legal thought.
